Overview
As States grapple with regulatory challenges in strategic sectors, the balance between the legitimate exercise of a State’s sovereign right to regulate and foreign investors’ right to investment protection is at the heart of many investment treaty arbitrations.
Vanguard has invited four preeminent experts to analyze Korea’s ISDS experience in the context of the broader global developments in ISDS and the rapidly changing geopolitical landscape.
The topic will be introduced by a thought-provoking keynote address delivered by James Castello, setting the stage for a critical panel discussion, featuring leading experts from private practice and government.
Through the lens of the high-profile disputes that Korea has been involved in, the panel will discern doctrinal trends and address strategic considerations, offering valuable insights for both host States and investors that have to navigate the increasingly complex legal and regulatory environment in which foreign investments are made today.
