Kim & Chang - Allen & Overy Webinar
“Modernization of Investment Treaty Arbitration:
Amendments to the ICSID Arbitration Rules"
I Event Description
Kim & Chang and Allen & Overy are pleased to invite you to a webinar on "Modernization of Investment Treaty Arbitration: Amendments to the ICSID Arbitration Rules” to be held on Tuesday November 2, 2021, from 5:00 pm to 6:30 pm (KST), 8:00 am to 9:30 am (GMT), as part of the Seoul ADR Festival 2021.
The interest in investor-state dispute settlement (ISDS) is growing significantly amongst investors in the APAC region, including in Korea. ICSID is the most commonly used forum for ISDS, and its arbitration rules are currently undergoing a comprehensive revision process – the first since 2006. This process, which has been characterized by an ongoing dialogue amongst ICSID, member states and other stakeholders, is expected to culminate in the adoption of a new set of rules in late 2021.
In this session, the panel of ISDS specialists will discuss the key features of modern ICSID Arbitration from the users’ perspective and consider to what extent the proposed amendments to the ICSID Arbitration Rules codify or reform the existing practice. The discussion will provide practical insights into current issues and potential pitfalls in ISDS and tools for effectively navigating modern ICSID Arbitration as users.
The webinar will comprise two panel sessions covering some of the key amendments to the ICSID Arbitration Rules:
- Session 1
Amendments to improve Transparency, Delays, and Mechanisms for Arbitrator Challenges
- Session 2:
A Modernized Toolkit for Bifurcation, Provisional Measures, Allocation of Costs and Security for Costs
