In this session, Driver Trett will host an interactive panel discussion with Yulchon and Samsung C&T. The discussion will attempt to answer the following question:
Given the strict requirements of independence and objectivity placed on an expert, and the assumption that all communications with legal counsel be disclosed, in substance if not through documentary disclosure, how can an expert provide early guidance regarding the merits of a claim without excluding them from being appointed as testifying experts once arbitration is initiated?
I Objective
Maximising the value of the expert witness. Educational discussion on the legal pitfalls when engaging experts early in a dispute so that they can be retained as potential expert witnesses once arbitration has been initiated.
