I Event Description

This panel will delve into critical, practical questions surrounding the integration of generative artificial intelligence (AI) in international arbitration, guided by the newly developed Silicon Valley Arbitration and Mediation Center’s (SVAMC) Guidelines on Using Artificial Intelligence in Arbitration (Guidelines).

 

These Guidelines incorporate extensive feedback from the international arbitration community. The panel will address a range of pressing and specific concerns practitioners increasingly encounter as AI becomes more intertwined with the practice of international arbitration, including:

  • AI in Drafting: Is it permissible to use AI tools for drafting awards, submissions, and expert reports? Should the use of such tools be disclosed to all parties involved?

  • Undisclosed AI Use: How should instances of undisclosed AI use be managed within arbitration proceedings?

  • Confidentiality Issues: What measures are necessary to safeguard confidentiality when employing AI in arbitration?

  •  AI-Generated Evidence: How can practitioners protect against AI-manipulated evidence and address the risks of AI “hallucinations” (inaccurate or fabricated information)?

  • Understanding Generative AI: What are the underlying mechanisms of generative AI, and what inherent risks do they pose to the integrity of arbitration?

 

The panel will feature SVAMC members who contributed to the drafting of these guidelines or have significant experience with AI and arbitration. It aims to equip arbitration professionals with specific knowledge and strategies needed to effectively harness AI, enhancing efficiency while maintaining the fairness and integrity of arbitration processes.
